Introduction

Welcome to Friender. These Terms of Service ("Terms") govern your access to and use of the Friender mobile application ("App"), including any content, functionality, and services offered through the App. The App is owned and operated by Friender LLC ("Company", "we", or "us").

Please read these Terms carefully before you start using the App. By downloading, accessing, or using our App, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our App.

Eligibility

The App is intended for users who are at least 18 years of age. By using the App, you represent and warrant that:

  • You are at least 18 years old;
  • You have the legal capacity to enter into a binding agreement with us;
  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations; and
  • You have not been convicted of a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence.

Account Creation and Security

To use certain features of the App, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Maintain the security of your account by not sharing your password with others and restricting access to your account and your device;
  • Promptly notify us if you discover or suspect any security breaches related to your account; and
  • Take responsibility for all activities that occur under your account and accept all risks of unauthorized access.

User Content and Conduct

Our App allows you to create a profile, upload content, and interact with other users. You are solely responsible for your user content and interactions with others.

User Content Guidelines

You agree that you will not post or share content that:

  • Is false, misleading, or deceptive;
  • Is defamatory, obscene, pornographic, vulgar, or offensive;
  • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
  • Is violent or threatening or promotes violence or actions that are threatening to any person or entity;
  • Promotes illegal or harmful activities or substances;
  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any party;
  • Contains software viruses or any other code designed to disrupt, damage, or limit the functioning of any computer software, hardware, or telecommunications equipment;
  • Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity; or
  • Violates the privacy of others or contains the personal information of others without their explicit consent.

Prohibited Activities

You agree not to:

  • Use the App for commercial purposes without our prior written consent;
  • Solicit money, goods, or services from other users;
  • Send spam or any form of duplicate or unsolicited messages;
  • Use the App to harass, bully, or harm another person;
  • Use automated systems, including but not limited to "robots," "spiders," or "offline readers," to access the App;
  • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the App;
  • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
  • Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the App; or
  • Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App.

Safety and Offline Meetings

Friender is designed to help you connect with new people, but we do not conduct criminal background checks or screenings on our users. It is your responsibility to take safety precautions when communicating with and meeting other users in person.

We recommend the following safety practices:

  • Always meet in public places for the first few encounters;
  • Tell a friend or family member about your plans;
  • Provide your own transportation to and from the meeting;
  • Stay sober and clear-headed during initial meetings;
  • Keep your personal and financial information private until you establish trust; and
  • Report suspicious or harmful behavior to both Friender and appropriate local authorities.

License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the App on a mobile device that you own or control and to run such copy of the App solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works based on the App;
  • Distribute, publicly display, publicly perform, or sublicense the App;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
  • Remove, alter, or obscure any proprietary notices on the App; or
  • Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

By submitting any user content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your user content in connection with the App and our business, including for promoting and redistributing part or all of the App (and derivative works thereof) in any media formats and through any media channels.

Subscriptions and Payments

The App may offer subscription-based services. By subscribing to our premium services, you agree to the following terms:

  • You authorize us to charge the applicable fees to your chosen payment method;
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period;
  • Subscription fees may change at any time, but we will notify you before any price changes take effect;
  • Payments are non-refundable, except as required by law or at our sole discretion; and
  • You are responsible for all applicable taxes related to your subscription.

To cancel your subscription, you must follow the cancellation procedures within the App or through your device's app store.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, secure, or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

We do not warrant or make any representations regarding the use or the results of the use of the App in terms of its correctness, accuracy, reliability, or otherwise.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;
  • ANY CONTENT OBTAINED FROM THE APP; AND
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your user content, any use of the App's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the App.

Governing Law

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

Dispute Resolution

Any legal action or proceeding relating to your access to, or use of, the App or these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the City of San Francisco. You and the Company irrevocably and unconditionally consent to the exclusive jurisdiction of such courts.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If a dispute is not resolved within 30 days of submission, you or the Company may bring a formal proceeding.

Changes to Terms of Service

We may modify these Terms at any time, in our sole discretion. If we do so, we'll let you know either by posting the modified Terms on the App or through other communications. It's important that you review the Terms whenever we modify them because if you continue to use the App after we have posted modified Terms, you are indicating to us that you agree to be bound by the modified Terms. If you don't agree to be bound by the modified Terms, then you may not use the App anymore.

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App's settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Account Deletion

In compliance with app store requirements and data protection regulations, we provide you with straightforward methods to permanently delete your account and personal data:

Account Deletion Methods

  • Within the app: Go to Settings > Account > Delete Account
  • Through our website: Log in at friender.lol, navigate to Account Settings > Delete Account
  • By email: Send a deletion request from your registered email address to datadeletion@friender.lol with the subject "Account Deletion Request"
  • By mail: Send a written request to Friender, Attn: Data Deletion Team, 123 Dating Lane, Match City, CA 94000, USA

Deletion Process

  • We will verify your identity to ensure the legitimacy of the request
  • Upon verification, your account and personal data will be deleted within 30 days
  • We will send a confirmation email once the deletion process is complete
  • Any active subscriptions associated with your account will be canceled
  • You will lose access to all matches, messages, and other content immediately upon initiating deletion

Data Retention After Deletion

After account deletion, we may retain certain information as required by law or for legitimate business purposes. Specifically:

  • Information needed for legal compliance and audit purposes
  • Aggregated and anonymized data that no longer identifies you
  • Information necessary to prevent fraud or future abuse
  • Information retained in backup systems for a limited time (maximum 90 days)
  • Content you shared with other users that they have not deleted
